The direct answer

No. A graduated rate estate must meet the conditions, including arising from the passing, being a testamentary trust, making the required designation and supplying the deceased person’s SIN in its returns. Only one estate can make the designation for that individual, and the status lasts no more than 36 months. The label should be checked rather than assumed.

Confirm the designation and time period

An estate does not receive graduated-rate treatment indefinitely simply because it arose after someone passed away. Give the preparer the date of passing, prior returns and relevant designations. The conditions and time limit must be checked for each period. Keep the estate's legal and tax information together so the status is not inferred only from its name.

Coordinate the estate's filings

If a different preparer handled an earlier year, obtain the submitted return and supporting elections or designations. Do not assume the current software selection proves the historical requirements were met. Explain any unusual arrangements or multiple estate-related trusts. A consistent record helps the preparer assess the estate's status and the consequences of changes over time.

What to gather before the review

  • Date of passing and estate documentation
  • Earlier T3 returns and designations
  • Relevant beneficiary and estate-structure information

Does probate delay automatically extend graduated-rate status?

No. The applicable time limit is tied to the tax rules, not simply to when administration finishes. Track the relevant anniversary and review status before the next filing.

Your next step

Bring the will, date of passing and any earlier T3 returns or designations.
