The direct answer
Generally, yes. Fees earned in the regular course of an executor’s business are treated differently from fees for holding the office outside such a business. CRA explains that the latter generally require T4 treatment with CPP and income-tax deductions, but not EI. A reimbursement of documented estate costs should be distinguished from compensation for the executor’s time.
Separate compensation from reimbursement
Keep the executor's compensation approval and payment details apart from repayment of documented estate expenses. A single transfer may include both, so request or prepare a clear breakdown. The executor's personal reporting should be reviewed separately from the estate's records. Being a family member does not automatically make compensation a tax-free inheritance.
Review reporting before payment
The nature of the executor's activities and the payment arrangement can affect treatment and reporting obligations. Provide the relevant facts rather than assuming that one standard slip or business classification applies in every case. Keep approval documents, service descriptions and expense receipts. If professional advice is needed on entitlement or compensation disputes, distinguish that legal issue from the tax calculation.
What to gather before the review
- Compensation approval and payment schedule
- Expense reimbursement receipts and breakdowns
- Description of executor duties and relevant business activities
Can I label executor compensation as an inheritance to avoid reporting it?
The label does not override the payment's actual character. Keep compensation and distributions distinct and have the applicable income and reporting treatment reviewed.
Your next step
Document approved fees and expense reimbursements separately and review reporting before payment.
