Do not treat a filed final return or a zero CRA balance as permission to distribute everything. A clearance certificate addresses the legal representative’s exposure to unpaid tax when distributing property. Review the outstanding returns, liabilities and proposed distribution before releasing estate assets. CRA: Apply for a clearance certificate
What the certificate protects
If a legal representative distributes property without clearance and tax remains owing, CRA can hold the representative personally liable up to the value distributed. The certificate confirms payment or accepted security for the relevant liabilities within its scope. It does not mean that every possible future estate issue disappears. A notice of assessment is a different document
An assessment reports CRA’s treatment of a return. CRA issues clearance after the required returns have been assessed and the relevant amounts have been paid or secured. Finishing the final T1 alone does not establish that the estate has completed all its tax work. CRA: Clearance certificate information circular
Income or gains arising after the date of passing can require a separate estate T3. Identify unfiled prior years and ongoing estate activity as well. This is why the executor should review the whole timeline rather than focus only on the last personal return. CRA: Returns after someone has passed away
What about a partial distribution?
CRA’s information circular says a certificate is not needed before each distribution if enough property is retained to pay the liability. That does not supply a standard safe holdback percentage. The amount needs to reflect the actual estate, outstanding issues and tax exposure. Coordinate any proposed partial payment with the estate’s tax and legal advisers. Write down what would remain after the distribution and which costs or taxes it is intended to cover. If major amounts are uncertain, bring those uncertainties into the discussion before setting a payment date with beneficiaries.
Prepare for the application
The application uses Form TX19 for income-tax clearance. CRA’s supporting-document requirements depend on whether the request concerns the person who passed away, the estate or another trust. Relevant records can include authority documents, asset details, assessments and actual or proposed distributions. GST/HST clearance, where relevant, has a separate form. - Will, appointment documents and the executor’s contact details.
- Final T1, applicable T3 returns and the corresponding assessments.
- Estate assets, values, costs and ownership records.
- Tax balances, payments and unresolved CRA correspondence.
- Distributions already made and a proposed plan for the remainder.
- Details of assets or income that have not yet been fully reported.
Common questions
Can the estate keep earning income while this is underway?
It can, and that activity needs to be included in the filing plan. A T3’s filing and balance-payment deadlines are generally 90 days after its year-end. Do not assume a pending clearance request suspends them. CRA: T3 filing and payment dates
What if another asset is discovered after clearance?
CRA says another certificate may be needed before distributing newly identified property that affects reported income or gains. Contact the relevant CRA office and update the estate records. CRA: Clearance certificate information circular
