Qualifying spousal-support payments can generally be deductible to the payer and taxable to the recipient. That result depends on the legal arrangement and the nature of the payments. A one-time property settlement is not automatically treated like periodic support.
Read the payment terms carefully
CRA's support rules look at matters such as a court order or written agreement, periodic payments, and whether the recipient can use the amount for support. The tax return distinguishes total support from the taxable or deductible portion. Registration of the arrangement with CRA may also be required.
Where child support is also payable, unpaid child-support obligations can affect the deductible spousal amount. Do not assume a transfer labelled “spousal support” settles the issue when the agreement includes both types of payments.

Reconcile the two sides
For example, an agreement may require separate monthly child and spousal payments, but the bank transfers show only one combined amount. Prepare a schedule separating the components and identifying missed payments. This gives both the payer and recipient a consistent factual record.
Documents to gather
- The signed agreement or order and every amendment.
- A payment schedule with bank confirmations.
- Any arrears calculation and correspondence about unpaid amounts.
- Details of lump sums, legal fees, or third-party payments.
Before signing a revised arrangement, ask for its tax treatment to be considered alongside legal advice. After the year ends, reconcile what was required with what was actually paid and received. If a prior return used the wrong treatment, review the affected years rather than trying to compensate by changing only the current year's figures.
