Shared custody for Canada child benefit purposes has its own CRA definition. It is based on the child's actual living arrangements and the other eligibility conditions, rather than simply the label in a parenting agreement.

Check the time spent in each household

CRA generally considers custody shared when a child lives with each parent between 40% and 60% of the time. Each eligible parent receives 50% of the amount they would receive with full custody, calculated using their own adjusted family net income.

Parents cannot simply choose to have one receive all the benefit when CRA's shared-custody rules apply. Changes in custody or marital status should be reported so payments can be recalculated.

Official guidance: [1], [2].

Why the two payments may differ

Imagine the child spends equal time in two households, but the households have different family incomes. The parents' payments need not be equal, because each calculation uses that parent's relevant family circumstances. Equal parenting time does not produce a single benefit amount that parents divide privately.

Prepare a custody record

  • Keep the parenting agreement and an actual calendar of overnight care.
  • Note when the shared arrangement began or changed.
  • Retain school, medical, or other records if CRA asks for support.
  • Ensure both adults' returns and marital-status information are current.

Check the resulting benefit notices for the correct child and period. The CCB calculation is separate from child-care deductions and the amount for an eligible dependant on a tax return. Review those claims individually rather than assuming the parent receiving a particular benefit must also claim every child-related tax amount.
