Child support under the modern rules is generally not deductible by the payer and is not taxable to the recipient. However, older agreements and later changes can require a different analysis. The actual court order or written agreement is the starting point.

Check the agreement date and payment type

CRA distinguishes child support from qualifying spousal support. Rules for agreements made before May 1997 may differ unless a change, election, or other specified event brings the payments into the newer treatment.

A transfer described informally as “support” is not enough to establish the tax result. Identify what the agreement requires, who must receive the payment, and whether the amount is for children, a former spouse, or both.

Do not turn a personal payment into a tax deduction

Suppose a parent pays a child's school bill directly and expects a child-support deduction. Paying a family expense does not, by itself, create that deduction. The support agreement and the rules for the specific expense need to be considered separately.

Keep a support-payment ledger

  • Include the agreement, court order, and amendments.
  • Record each payment date, amount, recipient, and purpose.
  • Separate child support from any spousal-support component.
  • Identify arrears, reimbursements, and payments made directly to third parties.

If the agreement is old, do not rely on last year's treatment without checking whether it changed. Support obligations can also affect an eligible-dependant claim even when the child support itself is non-deductible. Give your preparer the complete agreement rather than a summary of the amount paid. That allows related claims to be reviewed together and reduces inconsistent reporting between parents.
