For CRA purposes, a separation caused by a relationship breakdown generally must last at least 90 consecutive days. Once that condition is met, the effective separation date is the first day you began living apart. This timing can affect benefit calculations and the information on your return.

Establish what changed and when

Living in different locations for work or study is not automatically the same as a relationship breakdown. Record the facts, including when separate living arrangements began and whether you reconciled. CRA's general rule is to report a marital-status change by the end of the following month, with the special waiting rule for separation.

Do not wait for a divorce order to consider your tax status. Equally, do not choose “single” merely because you have moved out. Use the status that fits CRA's definitions and the relevant date.

Keep benefits and the annual return consistent

For example, two people who separate late in a year may not complete the 90-day period until the next year. Once the period is established, the effective date can still fall in the earlier year. Keep the status update confirmation with both years' records.

Prepare before updating

  • Write down the first day of living apart because of the breakdown.
  • Note any reconciliation or change in living arrangements.
  • Gather child-care and custody information separately.
  • Save CRA benefit notices issued before and after the update.

If circumstances are unusual, describe the facts to your preparer rather than trying to fit them into a convenient category. After CRA processes the change, review the revised payments and any overpayment notice. Updating marital status does not by itself resolve every claim involving children, support payments, or the family home.
