Family dividends can be subject to tax on split income, commonly called TOSI. Owning shares or being married to the business owner does not automatically make dividend splitting effective. The recipient's circumstances and the statutory exclusions must be reviewed.
Test the exclusion before paying
CRA describes TOSI as a special tax on certain income from a related business when it is not an excluded amount. Private-company dividends and some shareholder benefits can fall within the rules. Age, work involvement, ownership, and the type of business may affect available exclusions.
Do not confuse a reasonable salary for actual work with a dividend. They have different legal, payroll, and income-tax treatment. A change in label does not replace the underlying conditions.

Document the actual contribution
For example, a spouse may work in the business, invest capital, assume risk, or perform only occasional tasks. Keep evidence of those facts before deciding which exclusion, if any, is available. A general statement that “we run the business together” may not establish the necessary conditions.
Gather the family-business record
- Share ownership, classes, and acquisition dates.
- Work history, duties, and time records.
- Capital contributions and relevant risks assumed.
- Proposed dividends and the recipient's other income.
Ask your preparer to identify the specific exclusion relied upon and retain that analysis. Coordinate share changes with legal advice. Do not make a dividend payment based only on the recipient's lower ordinary tax bracket; the TOSI calculation may remove the expected benefit.
