A corporation can potentially pay reasonable rent for a genuine business use of space in a shareholder's home. The arrangement also creates reporting questions for the homeowner. It is not automatically a tax-free way to move corporate cash into a personal account.
Treat the arrangement as a real transaction
CRA's audit guidance discusses corporate home-office rent and the need for a reasonable expense connected with business operations. The shareholder's rental income and related expense entitlement must be assessed separately. Personal costs do not become deductible merely because the corporation agrees to pay them.
Compare rent with other appropriate reimbursement or employment-expense arrangements. Principal-residence, change-of-use, and possible GST/HST issues should be considered where relevant.
Support the amount and the business need
For example, an owner uses one room regularly for corporate administration. Document the space, use, and basis for the rent rather than choosing an amount equal to a desired personal mortgage payment. Explain why the company needs the space if it also has another office.
Prepare the arrangement file
- Description and measurements of the space.
- Business activities performed there and personal use, if any.
- Written terms and support for a reasonable charge.
- Home expenses and records of payments received.
Ask the preparer to compare the corporate deduction with the personal tax and compliance costs. Put the arrangement in place consistently rather than inventing rent after year-end to reduce profit. Retain the documentation with both the corporate and personal records so the two returns report the same transaction.
