The direct answer
No. CRA looks at where the trust’s central management and control actually takes place. A trustee’s address can be relevant but does not always determine residence. Multiple decision-makers or a move across borders can complicate the analysis. The practical conduct of the trust matters alongside the written deed.
Identify where substantive decisions occur
Record who actually makes decisions about investments, distributions and administration, and where that management takes place. A trustee's mailing address is relevant but not necessarily decisive. Explain any delegation or involvement of other people. The preparer needs the practical conduct of the trust, supported by its documents, rather than a province selected only from a postal code.
Review changes during the year
A trustee moving, a new adviser taking control or a change in decision-making arrangements can require attention. Keep meeting records and correspondence that explain how the trust operated. Do not assume the residence conclusion from a prior return remains correct indefinitely. Cross-border circumstances should be flagged early because the analysis can become more complex.
What to gather before the review
- Trust deed and trustee appointments
- Decision-making records and locations
- Details of moves, delegation and control changes
Can a trust choose a province simply by using an address there?
No. The residence analysis considers central management and control and relevant facts. A mailing arrangement alone does not establish the tax result.
Your next step
Record who makes substantive decisions, where those decisions are made and any changes during the year.
