The direct answer
Ordinary trusts generally face the highest federal individual rate on taxable income retained in the trust, with provincial tax also relevant. Graduated rate estates and qualifying disability trusts are important exceptions with conditions. Special trust regimes can differ. A trust is not automatically a low-tax account for family income; distributions and beneficiary taxation require a separate review.
Confirm the trust's tax category
A trust does not automatically receive the same graduated rates as an individual. Establish its type, relevant elections and status before estimating tax. Keep any claimed exception supported by the required information. An account named “family trust” is not a complete tax classification and should not be used as a shortcut to a low-rate assumption.
Review retention and distributions separately
Income retained in the trust and income allocated or made payable to beneficiaries can involve different calculations and reporting. Provide the trust terms, trustee decisions and payment records. Do not assume a bookkeeping entry alone produces the desired beneficiary treatment. The preparer must consider the actual arrangement and applicable rules for the year.
What to gather before the review
- Trust deed and classification information
- Relevant elections and prior returns
- Income, distribution and beneficiary records
Does creating a family trust automatically reduce the family's tax?
No. Trust rates, attribution, beneficiary reporting and other rules can affect the outcome. A trust should not be presented as a guaranteed low-tax account without reviewing the circumstances.
Your next step
Confirm the trust type and elections before estimating tax on retained income.
