A section 217 election can sometimes reduce Canadian tax on eligible pension and other Canadian-source payments received while non-resident. The calculation compares your circumstances under the election rules; it is not a guaranteed refund of withholding.

Check the income category and deadline

Eligible income can include CPP, OAS, many pensions, and certain RRSP or RRIF payments. Not every Canadian-source payment qualifies. Worldwide income information may be needed for the election calculation even when that income is not otherwise taxed in Canada under the election.

CRA generally sets June 30 of the following year as the section 217 filing deadline and April 30 as the balance-payment deadline. Other Canadian-source income can change the filing deadline. A late election is not simply treated like an ordinary late return.

Prepare a comparison before filing

For example, a retiree with modest Canadian pension income and different amounts of foreign income in successive years may have different election results. Use the actual figures for each year rather than assuming an earlier refund will repeat.

Gather the pension records

  • NR4 slips and details of tax withheld.
  • Canadian payment types and gross amounts.
  • Worldwide income and applicable personal information.
  • Treaty details and any approved NR5 reduction.

Ask your preparer to compare the election with the applicable withholding treatment and explain the deadline. Keep evidence that the return was filed on time. If an NR5 approval is in place, review its continuing filing conditions rather than assuming reduced withholding ends the annual compliance work.
