A net capital loss may be carried back to offset taxable capital gains in the three preceding years or carried forward to future years. It generally cannot be used against ordinary employment income, and a decline in value must normally be realized before it enters the loss calculation.
Confirm that the loss is available
Review the actual disposition, adjusted cost base, and any loss-denial rules. Investments held inside registered plans do not produce the same personal capital-loss claim as investments in a non-registered account.
CRA uses Form T1A for a current-year loss carryback request. Its guidance says not to file an amended return merely to apply that carryback. A carryback reduces taxable income in the earlier year, but does not change the earlier net income used for certain benefits.

Choose the application years deliberately
For example, a taxpayer with taxable gains in two eligible prior years can compare where the available loss is most useful. The original tax paid, other adjustments, and any previously used losses should be included in the review.
Prepare a loss schedule
- Current-year sales and supported cost bases.
- Earlier returns showing taxable capital gains.
- CRA carryforward balances and prior carryback requests.
- Repurchases or related-party transactions that may affect availability.
Ask the preparer to show how much loss is used in each year and what remains. Keep the reassessments together with the schedule so future returns do not reuse the same loss. Do not assume the broker's account decline is equal to the tax loss available for carryback.
