An in-kind distribution may be possible, and certain personal-trust distributions can occur on a tax-deferred basis. The trust terms, beneficiary's entitlement and residency, property type, and statutory exceptions must be checked before treating the transfer as a rollover.

A transfer is still a tax event to review

The Income Tax Act provides rules for distributions in satisfaction of a beneficiary's capital interest. Exceptions and elections can change the result. Non-resident beneficiaries, particular trust histories, and certain property can prevent the expected rollover.

Tax deferral does not necessarily give the beneficiary a new cost equal to current market value. Correct cost records must follow the property so the beneficiary can calculate a future gain accurately.

Document the transfer before execution

For example, a trustee wants to transfer a portfolio directly into a beneficiary's brokerage account. Confirm the entitlement and tax treatment before instructing the broker. A successful transfer by the institution does not confirm that the trust met the rollover conditions.

Gather the distribution package

  • Trust deed and trustee resolution.
  • Beneficiary's residency and nature of entitlement.
  • Tax costs, market values, and asset details.
  • Trust history, previous elections, and relevant attribution issues.

Ask the preparer and legal adviser to coordinate the resolution, reporting, and cost statement supplied to the beneficiary. Review any approaching trust anniversary or non-resident move before choosing the timing. Keep the distribution documentation with both the trust's final records and the beneficiary's ongoing investment records.
