Canada's residential property-flipping rule can treat profit from a Canadian housing unit held for less than 365 consecutive days as business income. It can apply even if you hoped to claim the principal-residence exemption.

Review the holding period and exceptions

The rule also covers certain rights to acquire a housing unit. Specified life-event exceptions may apply, but the facts must support the relevant exception. Where the deeming rule applies, a loss is generally deemed nil.

Meeting an exception or holding the property for at least 365 days does not automatically make the profit a capital gain. The ordinary business-versus-capital analysis still matters, including the purpose and circumstances of the transaction.

Keep the story supported by documents

For example, a genuine unplanned life change may explain a quick sale. Keep records of that event and the property timeline. A brief explanation written after the sale is less useful than contemporaneous evidence showing why the decision changed.

Prepare the sale review

  • Purchase and sale agreements with acquisition and disposition dates.
  • Your original plans and evidence of actual occupancy or rental use.
  • Documents supporting any claimed life-event exception.
  • Renovation costs, financing records, and selling expenses.

Ask for the income-tax treatment to be reviewed before the return is prepared. A GST/HST issue may also arise, particularly for new housing or assignment transactions. Do not rely on a simple “lived there” or “held it for one year” test as a complete answer to the property's tax treatment.
