No. A trust supporting a person with a disability is not automatically a qualified disability trust. QDT treatment requires a qualifying testamentary trust, an eligible beneficiary, a joint election, and continuing satisfaction of the rules.

Review the election each year

CRA requires the trust to arise on death and to elect jointly with one or more qualifying beneficiaries using the applicable form. The electing beneficiary must meet disability-tax-credit requirements and cannot make a conflicting QDT election with another trust for the relevant year. Canadian factual residency and other conditions also apply.

Recovery tax can arise in specified circumstances. A distribution or change in beneficiaries should therefore be reviewed before it is made, rather than assumed harmless because earlier returns qualified.

Coordinate the legal and tax records

For example, a will creates a trust for a child with an approved disability tax credit. The approval is important, but the trustee still needs to examine the trust terms, beneficiary identification, election, and annual conditions. The purpose stated in the will does not replace the tax test.

Prepare the QDT review

  • Will and trust instrument.
  • Beneficiary DTC approval and relevant tax-year information.
  • Prior QDT elections and trust returns.
  • Proposed distributions and changes in circumstances.

Ask the preparer to document eligibility and any recovery-tax exposure. Coordinate benefit-program considerations with appropriately qualified advisers, since a favourable income-tax result does not establish the effect on provincial disability support. Keep the annual election proof in the trust's permanent file.
