Sometimes. Estate donations can have flexible allocation rules when the estate and gift meet the applicable conditions. The timing of the actual transfer to the charity, the source of the donated property, and the estate's status are central.
Do not rely on the will alone
CRA generally treats estate donations as made when property is transferred to the qualified donee. Certain gifts by an estate meeting the graduated-rate-estate conditions can be carried back to the deceased person's final return. CRA's guidance includes a 60-month window and conditions concerning property acquired because of the death or substituted property.
The estate's usual donation claim and a carryback to the deceased are different possibilities. The same eligible gift cannot be used more than once.

Plan the payment and allocation together
For example, a will directs a charitable gift, but the executor is still selling assets and settling debts. Record when the gift is actually completed and obtain the correct receipt. The will's wording does not by itself show the amount and year available for the tax claim.
Gather the donation package
- Will provisions and estate-status information.
- Receipt from the qualified donee.
- Transfer date, value, and any advantage received.
- Records tracing the donated property or proceeds.
Ask the preparer to compare available allocation years and document the chosen treatment. Coordinate significant gifts with the estate's cash requirements and legal obligations. Keep the claim history with both the estate and final-return files so a later reassessment does not create a duplicate donation claim.
